Employers as Federal Contractors – Using E-Verify

This week, President Bush issued an Executive Order mandating that employers will be required to register for and utilize the USCIS’ E-Verify program in order to be eligible to obtain federal contracts.  The program compares information contained on I-9 (employment eligibility) forms, with records contained in DHS and Social Security Administration (SSA) databases, in order to confirm identity and work authorization for new hires.  Employers must enter into a Memorandum of Understanding (MOU) with DHS and SSA.  A Notice of Proposed Rulemaking (NPRM) will be published in the Federal Register, initiating a comment period for sixty days.  Basic features of E-Verify were covered in previous client announcements.  A User’s Manual, registration form and instructions may be found at www.uscis.gov/E-Verify.  If you are an employer with current federal contracts, or one seeking such federal contracts in the future, please contact our office to discuss the impact of this Executive Order in greater detail.
